        <p>A new candy shop by the name of Sweettooth has opened in the old Pink Rose Pastry Shop, on the NW corner of 4th &amp; Bainbridge in Philadelphia.&nbsp; Candy, nuts, dried fruits, etc. is sold by the 1/4lb (pricing, I believe, is around $2.49 or so, but don&#8217;t quote me on that).&nbsp; When you make your 1st purchase, you are given a punch card that allows for a free 1/4lb  after the purchase of 10.</p>

        <p>As a child, I would cart down the aisles of my local grocery store, rows of brand name products blurring past. Coasting on the cart as if I was driving a go kart at break neck speeds, I would pretend to drift at every turn, the tiny wheels screeching across the linoleum flooring, leaving excellent tread marks documenting my grocery cart driving prowess. However, any decent grocery cart driver needed his daily sugar fuel. </p>

<p>Whenever I passed the aisle of snack foods, I always begged my mother for some Choco-Pie. At first, she showed her reluctance. I already was quite the pudgy child, weighing over a hundred pounds at a very young age and food bills were already weighing heavy on the folds of my stomach. Even though my stomach boasted folds upon folds only middle aged men with no ambition could rival, the childlike look on my face could not be ignored. My mother bought me a box of Choco-Pie and I enjoyed every bite of that delicious chocolate pastry and soft marshmallow. </p>

<p>Even though I am in much better shape than my delightful chubby days of childhood, I still enjoy Choco-Pie. Its chocolate coating and fluffy breading are perfect with the soft marshmallow. I will never forget the flavor and texture of my first pie because I will eat it throughout my life!</p>

        <p>I spent three days at the all candy expo in Chicago last week, to find that i was very disappointed in Hershey&#8217;s showing.&nbsp; The booth this year was not as nicley done as years past, i feel like they didnt have as much to look at, i.e. displays.&nbsp; Also, i felt very intimidated when trying to apporach anyone to ask them any questions as the Hershey&#8217;s reps. swarmed together like bees.&nbsp; I have found them to be much more approachable and more friendly in the past.&nbsp; I am not sure what exactly is going on but Hershey&#8217;s is changing no doubt.&nbsp; I also noticed that this year unlike that of last year Hershey&#8217;s didnt have any Dogoba or Starbucks products to sample or even on display.&nbsp; Then i get home to hear the rumor that Hershey&#8217;s Starbucks is no more&#8230;.can anyone confirm?

        <p>I have heard rumors that more hershey&#8217;s chocolates will be manufactured in Mexico.&nbsp; Specifically chocolates that merchandizers like to call &#8220;3rd tier chocolates&#8221;; i.e. Payday, Fast Break, and Score bars.&nbsp; Anyone have any validation or discredit to this rumor?</p>

<p>I also heard that Hershey&#8217;s will be taking premium brands out of drug stores? Are they not selling?&nbsp; No more Bliss or Dagoba in my local Rite Aid? What is this?

      <title>Hershey&#8217;s Sends Jacques Torres C&amp;amp;D over Champagne Kiss</title>

        <p>A few weeks ago a little battle started. </p>

<p>Jacques Torres was sent a Cease &amp; Desist letter by the Hershey Company regarding their product, Champagne Kiss. They are asking Torres to stop using the name for their two year old product immediately. </p>

<p>The words KISSES is a registered trademark by Hershey&#8217;s. A trademark, unlike copyright, requires that the owner defend it at once. </p>

<p>Here&#8217;s the text of the letter that Torres received according to <a href="http://www.candyblog.net/?URL=http%3A%2F%2Fnymag.com%2Fdaily%2Ffood%2F2009%2F04%2Fhersheys_vs_jacques_torres_the.html">Grub Street at the NY Magazine</a>. </p>

<p>&nbsp;   </p><blockquote><p>It has come to the attention of the Hershey Company that Jacques Torres Chocolate is selling a chocolate product called “Champagne Kiss” or “Champagne Kisses.” We are concerned by your use of the name “Champagne Kiss” and “Champagne Kisses” in connection with this product as it infringes upon a number of trademarks used by The Hershey Company.</p>

<p>&nbsp;   For your information, the mark KISSES® is the subject of federal trademark registrations (Reg. Nos. 2,416,701; 3,363,296, and 3,493,764 among others) which are owned by the Hershey Chocolate &amp; Confectionery Corporation, a subsidiary of The Hershey Company. In addition, Hershey and its subsidiary (herein together referred to as “Hershey”) have acquired numerous other federal and common law rights in the KISSES® mark stemming from our long-standing use of this mark in connection with our famous HERSHEY®’s KISSES® chocolates. Through substantial use and promotion, the KISSES® mark is considered a famous mark and is afforded a broad scope of protection under trademark law.</p>

<p>&nbsp;   Hershey is concerned that Jacques Torres Chocolate’s use of the mark KISS or KISSES may cause consumer confusion with Hershey as to the source, sponsorship, or affiliation of Jacques Torres Chocolate’s product. Even in the absence of any likelihood of confusion, Jacques Torres Chocolate’s use of these Hershey-owned trademarks will dilute the trademarks in violation of federal and state anti-dilution statutes.</p>

<p>&nbsp;   Therefore, we demand that Jacques Torres Chocolate immediately discontinue its use of the mark KISSES or KISSES in connection with its chocolate candies. Please respond in writing by April 20th regarding what steps Jacques Torres Chocolate has taken or will be taking to accommodate these demands.</p>

<p>&nbsp;   Nothing in this letter should be construed as a waiver, relinquishment or election of rights or remedies by Hershey. Hershey expressly reserves all rights and remedies under all applicable federal and state laws.</p></blockquote>

<p><br />
And Torres&#8217;s lawyer replies:</p>

<p>&nbsp;   </p><blockquote><p>Mr. Jacques Torres has referred your writing of April 2, 2009 to me for response. Directly to the point, Mr. Torres will not discontinue his use of the term “Champagne Kiss.” We believe that this is yet another example of a giant, monolithic corporation attempting to take advantage of “the little guy,” in this case, a world-renowned artisan from France.</p>

<p>&nbsp;   Ms. Duquette, I can report to you that your concern of “consumer confusion” is without merit. Consider the following:</p>

<p>&nbsp;   I. The chocolates of Jacques Torres are considered “high end” and are not mass-produced and marketed as Hershey’s products are.<br />
&nbsp;   II. The first ingredient in Jacques Champagne Kiss is champagne. We are unaware of Hershey’s using champagne in any of its products.<br />
&nbsp;   III. The shape of Jacques’ product is rectangular and flat—nothing like a Hershey’s Kiss.<br />
&nbsp;   IV. The price points are radically different.<br />
&nbsp;   V. The availability of Hershey’s products versus the availability of products of Jacques Torres differs radically.<br />
&nbsp;   VI. The Champagne Kiss of Jacques Torres has an imprint of lips. The Hershey’s Kiss does not have any such imprint.<br />
&nbsp;   VII. Jacques’ product is called “Champagne Kiss.” That is, the product is described in the singular, not the plural.<br />
&nbsp;   VIII. The quality of the two products, in terms of ingredients, is like “night and day.”</p>

<p>&nbsp;   Ms. Duquette, there are multiple other reasons why the Champagne Kiss of Jacques Torres will never be confused with a Hershey Kiss.</p>

<p>&nbsp;   Mr. Torres vigorously disputes your contention that he is using or infringing upon a Hershey-owned trademark. The analogy might be similar to Chevrolet complaining that Rolls Royce is infringing on the Chevrolet trademark.</p>

<p>&nbsp;   Ms. Duquette, in summary, if a jury needs to decide this issue, then so be it.</p></blockquote>

<p>My person opinion is that Torres is in the wrong. Hershey&#8217;s actually has a season product for the past two Valentines called Champagne Kisses (sold in a bottle). Demonizing Hershey&#8217;s a some sort of a huge corporate bully against a teensy artisan are both rude &amp; unfair. </p>

<p>While people say that Torres confections are better, trademark does not mean that the entity doing the best job gets to use the name. I&#8217;m pretty sure that no one with both products in front of them would say that they are similar (the Torres product is a square truffle with an imprint of lipstick smooches on them while the Hershey&#8217;s version is of course a little dollop of chocolate wrapped in foil with a little flag). </p>

<p>A trademark is usually exclusive to a category. So you may find someone else using it, such as the tagline to the show Lifestyles of the Rich and Famous &#8220;Champagne kisses and caviar dreams&#8221; would not confuse and confectionery consumer. Nor would the introduction of a champagne Kiss lead someone to believe that it was a TV show about millionaires. </p>

<p>Lots of other companies &amp; services use the name Kiss and have separately registered it. <br />
Kiss (the band)<br />
Eskimo Kisses (clothing)<br />
Cake Kiss (cosmetics)<br />
Kiss (dermatological pharmaceutical implants)<br />
Baby Kiss (infant clothing &amp; accessories)</p>

<p>Besides Baci (Perugina/Nestle) which is Italian for Kiss, I could find no other companies with trademarks in the confectionery area. </p>

        <p>There is less than 2% caffeine in the energy mints so it&#8217;ll perk you up but not give you the caffeine shakes. The wintergreen energy mints taste just like the regular Breathe Savers or Ice Breakers wintergreen mints.</p>

<p>The dark chocolate Reese&#8217;s PBC are going to be one of the new dark chocolate products introduced this year. There will also be a Cookies and Creme Miniatures assortment bag that has milk and dark chocolate versions of the regular white chocolate and a few new varieties of Kisses.</p>
